Terms of Service

These Terms of Service ("Terms") govern your use of Ontrail, available at ontrail.dev (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are using Ontrail on behalf of a company or agency, you agree to them on its behalf.

1. The Service

Ontrail monitors websites you add to your account. It checks availability (uptime), SSL certificate status and page performance scores, sends email alerts, and lets you publish status pages and monthly reports for your clients.

Monitoring is performed from our infrastructure at regular intervals. We work hard to keep checks accurate and timely, but we cannot guarantee that every incident will be detected or that every alert will be delivered. Ontrail is a monitoring aid and not a substitute for your own backups, security measures or hosting provider's support.

2. Your account

• You must provide a valid email address and keep your login credentials secure.
• You are responsible for all activity under your account.
• You must be at least 18 years old, or the age of legal majority where you live.

3. Acceptable use

You may only monitor websites that you own, manage, or have permission to monitor. You agree not to:

• use the Service to attack, overload or probe systems you are not authorised to test;
• attempt to bypass plan limits, access other users' data, or interfere with the Service;
• resell or white-label the Service in a way that misrepresents who provides the underlying monitoring, except through the white-label features we offer;
• use the Service for anything unlawful.

We may suspend or remove sites or accounts that break these rules.

4. Plans and payment

Ontrail offers a Free plan and a paid Pro plan. Current plan features and prices are shown on our pricing section.

Payments are processed by our reseller and Merchant of Record, Lemon Squeezy, which handles billing, invoicing and sales tax/VAT. Your purchase is also subject to Lemon Squeezy's terms.

• Pro is billed monthly in advance and renews automatically until cancelled.
• You can cancel at any time from the Billing page. Pro features stay active until the end of the period you have already paid for; after that your account returns to the Free plan.
• If a payment fails, we may downgrade your account to the Free plan until payment is resolved.
• We may change prices with at least 30 days' notice by email. Changes apply from your next billing period.

Refunds are covered by our Refund Policy.

5. Downgrades and data

If your account returns to the Free plan, your existing sites and settings are kept, but Pro-only features (such as unlimited sites, white-label status pages, custom SMTP and client reports) stop working until you upgrade again.

6. Your content and your clients' data

You keep ownership of everything you add to Ontrail, such as site URLs, client names and client email addresses. You confirm that you are allowed to share this information with us and to have Ontrail email your clients (for example, alerts and monthly reports). How we handle this data is explained in our Privacy Policy.

7. Availability and changes

We aim to keep Ontrail running reliably but do not promise uninterrupted service. We may improve, change or discontinue features. If we discontinue the Service entirely, we will give you reasonable notice and refund any prepaid period you could not use.

8. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Ontrail will not be liable for any indirect, incidental or consequential damages, or for lost profits, revenue or data, arising from your use of the Service — including missed or delayed alerts. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Termination

You can stop using Ontrail and ask us to delete your account at any time by emailing us. We may suspend or terminate accounts that violate these Terms.

11. Changes to these Terms

We may update these Terms from time to time. If a change is significant, we will notify you by email or in the app before it takes effect. Continuing to use Ontrail after that means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Mandatory consumer protection laws of your country of residence still apply where relevant.
